TERMS AND CONDITIONS OF SALE
1 - Preamble
The terms and conditions of sale detailed below apply to all orders placed with Art Montessori canusmex Inc for all items offered on the site artmontessori.ca, unless there is a different written agreement.
The terms and conditions of sale applicable to any transaction on the artmontessori.ca website are those mentioned online on the said site at the time the customer places an order. The client acknowledges having read these conditions prior to placing an order.
Consequently, the fact of placing an order on the artmontessori.ca site implies full and complete acceptance of these terms and conditions of sale by the customer.
2 - Price
2-1 - The prices are expressed in Canadian, taxes not included, participation in the expenses of treatment and shipping.
2-2 - In case of an order to the United States or Mexico, the buyer is the importer of the product(s) concerned. For all products shipped outside Canada, customs duties, other local taxes, import duties or state taxes may be due and payable by the customer. These duties and sums are not the responsibility of Art Montessori Canusmex inc. They will be charged to the buyer and are his entire responsibility both in terms of declarations and payments to the authorities and competent organizations of the country concerned.
2-3 - All orders are payable in Canadian.
2-4 - Art Montessori Canusmex Inc. reserves the right to modify its prices at any time on its website artmontessori.ca. The products are billed on the basis of the rates in effect at the time of order registration, subject to availability. The products remain the property of Art Montessori Canusmex Inc. until full payment of the sale price.
3 - Order and Validation
3-1 - The customer of the company Art Montessori Canumex Inc. must be of legal majority and not be protected under the terms of Article 488 of the Civil Code. The company Art Montessori Canusmex Inc. reserves the right to refuse an order if the customer in question presents a default of payment in his order history.
3-2 - These conditions are available on the website artmontessori.ca. At the customer's request, these can be sent by email or by mail.
3-3 - When the customer clicks on the "Validate" button after the order process, he declares that he accepts the order and the present general terms and conditions of sale fully and without reserve. The data recorded by Art Montessori Canusmex inc. constitutes the proof of all the transactions made by Art Montessori Canusmex inc. and its customers. The data recorded by the payment system constitute proof of financial transactions.
3-4 - The Customer is responsible for the accuracy and completeness of the information provided by himself on his customer account and on his order to ensure its proper processing. The company Art Montessori Canusmex inc. cannot be held responsible for delays or additional delivery costs. The expenses incurred by the company Art Montessori Canusmex inc. resulting from errors in the information provided by the Customer will be charged to the Customer.
4 - Availability
Our product offers are proposed within the limits of available stocks. In this context, indications on the availability of products are provided to the customer at the time of placing the order. If the items are unavailable for a period of more than 6 weeks after the order is placed, the company Art Montessori Canusmex inc. will inform and invite the customer to cancel or modify his order.
5 - Delivery
Art Montessori Canusmex Inc. delivers its products in Canada and the United States.
All our products are made in Canada and are shipped with a delivery note to the address indicated by the customer when ordering. Delivery cannot be made to hotels or post office boxes. The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times. In order for these times to be respected, the customer must ensure that he/she has provided accurate and complete information concerning the delivery address (such as, in particular: civic number, street name, apartment or suite number, city and province and country).
In-stock products are usually packed and leave our warehouse within 2 business days. Out of stock products have a manufacturing delay of approximately 10 business days unless there is a shortage of raw material. An email is sent to the customer to inform them of the situation and the progress of their order.
In times of pandemic, packages sent by carrier do not require a signature so it is the customer's responsibility to track their package with the tracking number sent by Art Montessori Canusmex and to make sure they are present when it arrives. Neither Art Montessori Canusmex nor the carrier will be responsible for lost or stolen packages.
In the case of local delivery, we make an appointment with the customer to ensure that there is an adult presence at the time of delivery. If there is no response at the time of delivery, our delivery person may leave with the package in question. We will contact you to schedule a second delivery appointment or allow you to pick up at our facility.
If we have to deliver a second time, you will be charged a delivery fee as follows: The greater of the minimum of twice the local delivery price already charged or $40. This amount must be paid before the second delivery.
In case of damaged packages, the customer agrees to notify the carrier upon receipt and Art Montessori Canusmex Inc. by any means (mention on the delivery note, photos) within 3 days of receipt of the product, otherwise, no claim can be made.
Art Montessori Canusmex inc cannot be held responsible for the consequences due to a delay in delivery not being of its own making.
6 - Payment
6-1 - For private individuals and non-professionals, manufacturing work is payable in full when the order is placed. Payment is made by credit card (Visa, MasterCard, American Express) or by phone with debit-visa card.
The company Art Montessori Canusmex inc. implements all necessary means to ensure the security and confidentiality of data transmitted online.
6-2 - Orders from early childhood professionals are subject to an estimate sent to the customer by email with bank details Art Montessori Canusmex nc. The " voucher for agreement " of the estimate is accompanied by the payment of 30% deposit by bank transfer. The balance is to be paid on invoice within a maximum of 15 days after delivery.
6-3 - Orders from municipalities and local authorities are subject to an estimate sent to the customer by email. This quotation must be signed by an authorized person with the mention "good for agreement for the sum of........".
The payment of the order is made on invoice after full delivery by cheque or bank transfer.
In case of delivery or shipping, a packaging and shipping fee is to be added.
7 - Return and return policy after sale
7-1 - We accept returns for exchange and refund within 30 days of receipt of the package. The customer benefits from a cooling-off period of 30 days from delivery to return the item(s) ordered without having to pay any penalties, except for the return costs, which will remain at his or her expense. Items must be returned in their original packaging, complete, new. The final decision as to whether the product is considered new is at the discretion of Art Montessori Canusmex inc.
The return costs must be paid before sending you the return label to be affixed to the box. The refund of your purchase will be made upon receipt of your purchase.
Items sold at a discount are considered final sales.
If a product comes in a box, the box must be in as good condition when returned as when it was sent. If the product has been sent on a pallet, we will arrange pickup if necessary.
No refunds or exchanges on rattles.

Items returned incomplete or damaged by the customer will not be refunded.
The risks and return costs are always the responsibility of the customer.
We invite the customer to return the parcel by any means providing proof and giving certain date to its shipment.
7-2 - If the return is due to an error on the part of Art Montessori Canusmex inc., the shipping costs for the outward and return delivery that were paid by the customer will be refunded. For this the customer must include in his return package a proof of shipping costs to be reimbursed.
Once the goods are received, controlled, and accepted by our services, the refund of the items returned at the invoiced price will be made by credit to the bank account of the customer corresponding to the bank card used for payment no later than 14 days after receiving the returned items.

7-3 - Return policy outside Canada.
Return and exchange costs are at the customer's expense outside of Canada. Outside of Canada, customs duties and fees, and formalities fees are the responsibility of the customer.

8 - Intellectual property
All elements of the artmontessori.ca site, whether visual, graphic, video or audio, are protected by copyright, trademarks or patents. They are the exclusive property of Art Montessori Canusmex inc. Consequently, the partial or total reproduction, on any medium whatsoever, of the elements composing the site and the catalogue, their use and their availability to third parties are strictly prohibited.
9 - Responsibility
The products offered are in conformity with the Canadian legislation in force. The responsibility of Art Montessori Canusmex inc. could not be committed in the event of nonrespect of the legislation of the country in which the products are delivered. It is up to the customer to check with the local authorities the possibilities of importation or use of the products he intends to order.
The photographs and texts reproduced and illustrating the products presented are not contractual. As a result, Art Montessori Canusmex Inc. cannot be held liable in the event of an error in any of its photographs or texts.
Art Montessori Canusmex inc. cannot be held responsible for the non-performance of the contract in case of stock shortage or unavailability of the product, force majeure, total or partial strikes, internal or external to the company, blockage of means of transport or supply for any reason whatsoever, governmental or legal restrictions, computer failure, blocking of telecommunications including networks and especially the Internet.
Art Montessori Canusmex inc. shall not be held liable for any indirect damages arising out of this agreement, business interruption, loss of profit, damages or expenses.

10 - Protecting personal data
Art Montessori Canusmex inc. agrees not to divulge to third parties the information communicated on the site artmontessori.ca; this information is confidential. This information may be used to personalize the communication and the offer of products reserved for Art Montessori Canusmex inc. customers.
Accordingly, in accordance with the Computer Law and Freedoms of 6 January 1978, the client has a right of access, correction, and opposition to personal data concerning him. All you need to do is apply online or by mail with your name, first name and address.
